Terms of Service

1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the AlertFlow platform and services (“Service”) provided by AlertFlow, Inc. (“AlertFlow”, “we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

AlertFlow provides a cloud-based alert management, on-call scheduling, and incident response platform designed for managed service providers. The Service includes web application access, API access, notification delivery (email, SMS, voice), and workflow automation.

3. Account Registration

To use the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Promptly notify AlertFlow of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

4. Subscription and Billing

4.1 Plans and pricing

AlertFlow offers subscription plans as described on the pricing page. Prices are in USD and exclude applicable taxes.

4.2 Free trial

New accounts receive a 14-day free trial. No credit card is required to start. After the trial, continued use requires a paid subscription.

4.3 Payment

Subscriptions are billed in advance on a monthly or annual basis. All payments are processed by Stripe. By providing payment information, you authorize AlertFlow to charge you on a recurring basis.

4.4 Refunds

AlertFlow offers a 30-day money-back guarantee on new paid subscriptions. Refund requests must be submitted within 30 days of the charge via support@alertflow.io.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Send spam or unsolicited communications
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to any system or network
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or transmit malicious code
  • Resell or sublicense access to the Service without written permission

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy, incorporated herein by reference. You retain ownership of all data you submit to the Service (“Customer Data”). You grant AlertFlow a limited license to process Customer Data solely to provide the Service.

7. Intellectual Property

AlertFlow and its licensors own all right, title, and interest in and to the Service, including all intellectual property rights. These Terms do not grant you any rights to AlertFlow's trademarks, logos, or other brand features.

8. Uptime and Service Levels

AlertFlow targets 99.9% monthly uptime for the core alert routing pipeline. Scheduled maintenance windows are announced at least 48 hours in advance via the status page at status.alertflow.io. Enterprise customers receive uptime SLA guarantees in their agreements.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALERTFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE.

ALERTFLOW'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ALERTFLOW DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

11. Termination

Either party may terminate these Terms at any time. AlertFlow may suspend or terminate your access for material breach of these Terms, including non-payment, with notice where practicable. Upon termination, your right to use the Service ceases. Customer Data is retained for 90 days post-termination before permanent deletion.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts of Delaware.

13. Changes to Terms

AlertFlow reserves the right to modify these Terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance.
